Rulebook for issuing, renewing or revoking a license for dowsers

About DETAILED CONDITIONS FOR ISSUING, RENEWING OR REVOCATING LICENSES TO PRACTITIONERS OF TRADITIONAL METHODS MEDICINE RADIATION DETECTION - RADIESTHESIA

AND INTRODUCTORY PROVISION

Regulations on detailed conditions for issuing, renewing or revoking licenses to practitioners of the method of traditional medicine, radiation detection, dowsing, are harmonized with the provisions of the Law on Health Protection of Citizens of Serbia ("Official Gazette of the RS", no. 107/2005, 72/2009 - other laws, 88/2010, 99/2010, 57/2011, 119/2012, 45/2013 - other laws, 93/2014, 96/2015 and 106/2015), of the Rules of Procedure, method and procedure of performing methods and procedures of traditional medicine ("Official Gazette of the RS No. 07/05 and 119/2007), in which the method of radiation detection - dowsing is recognized as a method in the framework of rehabilitation.

The regulations are adopted with the aim of further affirmation and professionalization of practitioners of traditional medicine methods of radiation detection and protection against non-ionizing radiation - dowsing (hereinafter TM DZ/R)respecting all the obligations according to the aforementioned Laws, but also taking into account all the specifics of the TM DZ/R method, which can be practiced in activities that do not require exclusively knowledge of medical sciences, and in many ways contribute to improving health and protecting the environment.

 

The provisions of this rulebook are binding for all registered practitioners of the radiation detection method in accordance with the chamber organization system and internal documents: Statute of the BIOGEN association, The Code of Ethics and the Code of Competence of TM DZ/R Method Practitioners, which regulate the area of good practice and practice of the method depending on formal education. Association BIOGEN, until the formation of the Professional Chamber of Traditional Medicine or the Chamber of Practitioners of the Traditional Medicine Method of Radiation Detection - Dowsing (hereinafter referred to as the Chamber), adopts this Rulebook with the aim of strengthening the potential of the method, continuous development of the educational methodology, as well as the protection of citizens in terms of and in connection with the Law on Consumer Protection ("Official Gazette of RS", No. 62/2014 and 6/2016 - Dr. Law)

Article 1

Practitioners of the TM DZ/R method can be any person, regardless of: race, gender, nationality, social origin, birth, religion, political or other belief, property status, culture, language, with at least graduated high school.

Practitioners of the TM DZ/R method can be adults with preserved mental and physical stable health, sociologically balanced - non-excessive person.

Article 2

The TM DZ/R practitioner license is issued by the competent committee of the legal entity of the Association "BIOGEN" until the formation of the professional chamber, when all competences from this rulebook pass to the competence of the expert commission within the organizational part of the chamber, which will be formed after the formation of the competent chamber, and no later than within six (6) months after the formation of the chamber.

Article 3

This rulebook establishes the detailed conditions for issuing, renewing or revoking authorization for independent work (hereinafter: license) to registered practitioners of the TM DZ/R method (hereinafter: practitioner), procedure and the manner of issuing, renewing or revocation of the license, the form and content of the issued, renewed or revoked license, as well as other conditions required for the issuance, renewal or revocation of the license.

Issuing, renewing and revoking a license is a procedure carried out by the competent commission of a legal entity that carries out professional training, education, conditioning and verification of the ability of practitioners to practice the TMDZ/R method by registered practitioners, and in order to determine the practitioner's professional competence for independent work.

Article 4

A license is a public document that proves the professional competence of a practitioner of the TMDZ/R method for independent performance of activities in the Republic of Serbia.

The license is issued to practitioners of health and non-health formal education methods in accordance with the code of ethics and the code of competence when performing the same, in accordance with valid legal regulations and other by-laws that regulate this area.

The decision on issued, renewed or revoked licenses is made by the president of the competent commission of the association for issuing licenses, and on the proposal of the president of the program council, the president of the ethics committee and the professional commission of the association that issues the license

The license is issued for a period of three (3) years.

II LICENSE ISSUANCE PROCEDURE

Article 5

The legal entity issues a TM DZ/R method practitioner license to a health worker and a member of the legal entity who has completed training according to the curriculum and program (NPP) of the TM DY/R method practitioner training, which is has passed all the professional exams planned by the NPP and is registered in the register of practitioners of the TM DZ/R method, which is maintained by a legal entity.

Article 6

A registered practitioner submits an application for the issuance of a license to the competent commission of the legal entity authorized to issue the license.

The request from paragraph 1 of this article is submitted to the competent commission through the business entity of the Association "BIOGEN", Belgrade.

Article 7

Registered practitioner, foreign citizen, who on the territory of the Republic of Serbia occasionally performs activities within the scope of work of the practitioner of the TM DZ/R method (business-technical cooperation, professional consulting services), submits to the competent commission proof of membership in a professional chamber in the field of traditional medicine of the country where the practitioner is a citizen, i.e. a professional association from that country, as well as a valid certificate of registration in the Register of Practitioners of the country in which he performs his activities in the field of work of practitioners of TM methods.

Article 8

With the request from Article 6 of this rulebook, the registered practitioner, in order to obtain a license, submits the following documentation:

1) a decision on membership in a registered professional association that deals programmatically and by statute with the TM DZ/R method (detection and protection from non-ionizing radiation);

2) a certified photocopy of a certificate or diploma from a scientific field for second-degree studies (graduate academic studies - master, master vocational studies, specialist academic studies, specialist vocational studies), i.e. in first degree studies (basic vocational and basic academic studies lasting at least three years), higher schools and schools for secondary and professional staff; medical or non-medical scientific fields;

3) a certified photocopy of the certificate of passing the professional exam (for registered practitioners who have completed formal education in the health-medical education profile), and registered practitioners who do not have a health-medical education profile the obligation to submit a photocopy of the certificate of passing the professional exam of your educational profile;

4) a certified high, higher or secondary diploma in the health profession obtained abroad.

5) A healthcare worker who has acquired a teaching-scientific title, i.e. the title of primarius, submits certified photocopies of the certificate of the acquired title, i.e. the title.

6) Proof that the healthcare worker has not been convicted by a final court decision of a criminal offense that makes him unfit to perform healthcare activities, i.e. that he has not been sentenced to prison for a serious crime against people's health by a final court decision the competent chamber obtains from the competent authority ex officio.

7) proof (medical certificate) that he is medically fit to practice the TM DZ/R method, that he has no health or psychological limitations for working with people and in a team;

8) proof of payment of funds to the license issuer's account for license issuance costs

Registered practitioner of health and non-health educational profile who has submitted a certified photocopy of the certificate as proof instead of a certified photocopy of the diploma, where it is requested as proof, is obliged to submit as proof after the diploma is issued a certified photocopy of the diploma.

Article 9

A practitioner of the TM DZ/R method, a health worker, who performs specialist activities, in addition to the documents from Article 8 of this rulebook, submits the following documents with the application for the issuance of a license:

1) a certified photocopy of a diploma on a passed specialist exam, i.e. a certified diploma on a passed specialist exam obtained abroad;

2) a certified photocopy of the diploma on the passed exam in the narrow specialty, i.e. the certified diploma on the passed exam in the narrow specialty obtained abroad.

Article 10

If a practitioner, healthcare worker, within the validity period of the license acquires the professional title primarius or teaching-scientific title, he is obliged to inform the legal entity Association.

In the event that the circumstances referred to in paragraph 1 of this article occur, a new license with the same license number and validity period is issued to the practitioner - health worker.

If a practitioner, healthcare worker, within the validity period of the license, passes a specialist or subspecialty exam, he is obliged to inform the competent legal entity that issued the TM DZ/R method license.

In the event that the circumstances referred to in paragraph 3 of this article occur, a new license with the same validity period is issued to the healthcare worker.

III NOMENCLATURE OF TITLE AND OCCUPATION IN THE FIELD OF THE TM DZ/R METHOD

Article 11

In line with provisions of the Law on Health Protection of Serbian Citizens, especially Articles 235, 236 and 237 of the aforementioned Law ("Official Gazette of the RS", No. 107/2005, 72/2009 - other laws, 88/2010, 99/2010, 57/2011, 119/2012, 45/2013 - other laws, 93/2014, 96/2015 and 106/2015), of the Rulebook on detailed conditions, methods and procedures for performing methods and procedures of traditional medicine, and in relation to Article 6 paragraph 1 point 6; Article 11, paragraph 1, point 2.3 ("Official Gazette of RS No. 07/05 and 119/2007") establishes the nomenclature of occupations and titles, jobs and conditions in terms of education, i.e. professional qualifications for obtaining the license of registered practitioners of the TM DZ/R method.

Professions and occupations are gender equal, so according to the provisions of the Law on Gender Equality (Official Gazette of the Republic of Serbia No. 104/2009) the same are entered in the license in the male and female genders: RADIESTHESIST and FEMALE RADIESTHESIST

In the text of the Rulebook, only the noun of the professional title will be used in the masculine gender, and in the license both genders will be used equally.

Registered TM DZ/R Health Profile Practitioner with

  1. completed second degree studies (graduate academic studies - master, master professional studies, specialist academic studies, specialist professional studies) acquires the right to the title - DOCTOR OF MEDICAL SCIENCES; MASTER OF MEDICINE; SPECIALIST IN MEDICINE - (to be added) - RADIESTHESIS PRACTITIONER
  2. first degree studies (basic vocational and basic academic studies lasting at least three years); higher schools and schools for secondary and professional staff; acquires the right to a license and title - RADIESTHESIS PRACTITIONER THERAPIST

A registered practitioner of the TN DZ/R method who has completed a formal education of a non-health educational profile acquires the right to a license and title - RADIESTHESIS PRACTITIONER.

The domain of work, the area of operation and application of the TM DZ/R method for all licensed and registered practitioners are more closely determined and defined by the Code of Ethics and the Code of Competence which was adopted by the legal entity of the licensor, the BIOGEN Association.

Article 12

A practitioner of the TM DZ/R method can have his license renewed if, during the license validity period of three (3) years from the moment of issue, he has acquired 150 points.

Points for license renewal are earned by actively participating as an observer or lecturer in:

  1. procedure of continuing medical education,
  2. education of practitioners of traditional medicine,
  3. professional training by attending conferences, congresses, consultations, workshops related to the practice of the TM DZ/R method and/or protection from electromagnetic, non-ionizing radiation at the local, regional, national and international level for which he has submitted a valid certificate of participation as a listener or lecturer;
  4. through the content of the continuing education program related to the professional performance of activities within the registered method of TM DZ/R that he performs, and for which the license is issued or renewed.

As an exception to paragraph 1 of this article, when determining the total number of points required for license renewal, it is considered that a healthcare worker who submits an application for license renewal that was acquired before January 1, 2017, in the period from obtaining the license until December 31, 2016, acquired a sufficient number of points to renew the license, regardless of the number of points actually acquired.

The number of accumulated points in one year of the license cannot be less than fifty (50).

A total number of one hundred and fifty (150) points must be collected from several different activities of the practitioner's work: education, information, continuous conditioning, as well as application and practice of the method.

Article 13

In order to renew the license, the practitioner submits a request 60 days before the expiration of the term for which the license was issued.

The request for license renewal is submitted to the legal entity that issued the license, and the date of submission of the request, if the request is submitted by mail, is valid on the postmark.

Practitioners of the health profession are also recognized for points acquired through the process of continuous medical education, with the fact that fifty percent (50%) of these points are acquired in the health field of TM, and at least thirty percent (30%) of points from meotde TM DZ/R.

In addition to the request from paragraph 1 of this article, the healthcare practitioner, in relation to paragraph 3 of this article, also submits:

  1. evidence that during the period of validity of the license he acquired the required number of points from Article 12 paragraph 1 and 2 of this rulebook, which the competent commission of the legal entity can also determine on the basis of data from the electronic database of the competent chamber of health workers;
  2. certificate issued by a health institution, i.e. private practice, that at least 50% of the time since the day of the license was issued, he worked in the field of health activity for which he has a license.

The practitioner of the TM DZ/R non-health educational profile method, for the purpose of renewing the license, submits evidence regarding Article 12 paragraphs 1 and 2 and is exempted from the obligation to submit evidence from paragraph 3 and paragraph 4 1 and 2 of this article.

Article 14

If the practitioner has not obtained a minimum of 50 points at the end of the license year, he is obliged to submit a request to take the license exam within 60 days before the end of the license year.

If the practitioner has not obtained a total of 150 points at the end of the license period of three (3) years, he is obliged to submit a request to take the license exam within 60 days before the end of the license period.

If the practitioner lacks points for fulfilling the conditions established in Article 12 paragraph 1-5 of this rulebook, he is obliged to take an exam before the competent committee of the chamber.

Article 15

The commission for taking the license exam consists of:

  1. president of the legal entity responsible for issuing the license-association BIOGEN,
  2. president of the program council of the professional association of TM DZ/R method practitioners,
  3. president of the expert commission of the professional association of TM DZ/R method practitioners,
  4. president of the ethical committee of the professional association of practitioners of the TM DZ/R method,
  5. head of the TM DZ/R method practitioner course;

The composition of the licensing commission, in addition to the five permanent members from the previous paragraph 1 of this article, also includes at least one member each from the Section of Traditional Medicine (health profession), the Ministry of Health and the competent Ministry, which also includes the Department of Life environment.

At least two members of the Commission must have at least the same degree as the candidate taking the license exam.

Article 16

In the process of deciding on the request for renewal of the license, the competent commission is obliged to determine ex officio that none of the reasons for revocation of the license established by Article 197 of the Law on Health Care or as a result of any act have occurred punishable by the Criminal Code of the Republic of Serbia ("Official Gazette of RS", No. 85/2005, 88/2005 - corrected, 107/2005 - corrected, 72/2009, 111/2009), 121/2012, 104/2013 and 108/2014), or by pronouncing a final verdict for the offense for which is threatened with a punishment of at least three days, and it was done within the scope of providing and practicing this method as well as other TM methods.

Article 17

A practitioner of the TM DZ/R method who, in accordance with the regulations governing the field of work, has been determined to have a suspended employment relationship, maternity leave and leave from work for child care, leave from work for special child care or temporary incapacity for work in the period:

  1. up to two months during the license year, in the license renewal procedure, he is obliged to fulfill the conditions from Article 12 of this rulebook;
  2. up to six months during the license year, the period of validity of the license remains unchanged, and in the process of renewing the license it is necessary to acquire at least twenty-five (25) points in the process of continuous education and/or another form in that license year;
  3. for more than six months during the license year, i.e. one or more license years, the validity period of the license remains unchanged, and in the license renewal procedure, it is considered that in that license year, i.e. those license years, he has acquired a sufficient number of points for license renewal, regardless of the actual points acquired in the specified period.

The practitioner of the TM DZ/R method submits evidence to the competent commission for issuing a license that the conditions from paragraph 1. and 2. of this article.

IV REVOCATION OF LICENSE

Article 18

The TM DZ/R practitioner's license may be revoked temporarily or permanently.

Article 19

Competent legal entity for issuing licenses to practitioners of TM DZ/R temporarily revokes the license:

  1. if the practitioner does not renew the license under the conditions prescribed by law;
  2. if the practitioner performs an activity for which he has not been issued a license;
  3. if the practitioner makes a professional error in performing the activity and practicing the method, which impairs or worsens the patient's condition or misleads the patient regarding the results of radiation detection;
  4. if the practitioner has been issued one of the measures of a temporary ban on independent work by the competent authority of the legal subject of the "BIOGEN" Association, which issued the license and keeps the practitioner in the register of practitioners for the method, due to a serious violation of the professional duty and reputation of a member of the "BIOGEN" association, in accordance with the laws that regulate the field of activity and work of practitioners of registered methods, the Association's Statute "BIOGEN", the Code of Ethics or the Code of Competence of TM DZ/R Method Practitioners;
  5. if the practitioner was convicted by a final court decision of a criminal offense that makes him unfit to practice the profession of TM DZ/R method practitioner;
  6. if in the performance and practice of the method, he misuses funds and trust in the service provider;
  7. if the practitioner, with his conscious or unconscious actions, endangers and damages the reputation of the TM DZ/R method practitioner profession and the personal reputation of other registered licensed practitioners of this method;
  8. in other cases prescribed by law.

Article 20

To the practitioner of the TM DZ/R method, the competent legal entity that issued the license, the "BIOGEN" Association, permanently revokes the license if he is sentenced by a final court decision to prison for a serious crime against health people.

Article 21

A practitioner of the TM DZ/R method whose license has not been renewed by the competent legal entity, Association "BIOGEN", or whose license has been revoked, under the conditions prescribed by law and this rulebook, is obliged to within eight (8) days from the date of receipt of the decision, submit the previously issued license to the competent legal entity, the "BIOGEN" Association.

Article 22

The competent legal entity, the Association "BIOGEN", which issued a decision to the practitioner of the TM DZ/R method on the temporary or permanent revocation of the health worker's license, informs the employer of the health worker and the branch Republic Institute for Health Insurance.

The competent legal entity, the "BIOGEN" Association, which issued a decision to the practitioner of the TM DZ/R method on the temporary or permanent revocation of the license of a practitioner who is not a health professional, informs the competent chamber (upon establishment).

V APPEARANCE AND CONTENT OF LICENSE

Article 23

The license is issued on an A3 form, size 420 x 297 mm.

Article 24

The form contains the coat of arms of the Republic of Serbia, the name and logo of the competent legal entity of the Association "BIOGEN".

The following information about the TM DZ/R method practitioner is entered on the license:

  1. name and surname;
  2. school preparation; title from formal education;
  3. method of traditional medicine for which the license is issued;
  4. license number;
  5. date and place of license issuance;
  6. license validity date;
  7. the seal of the competent legal entity, the Association "BIOGEN", and the signature of the responsible person, the president of the licensing association (in the right corner, and after the formation of the professional chamber of traditional medicine - the seal of the competent chamber.

Article 25

The printing of the license is done in the printing house on the basis of the Agreement on business and technical cooperation on the printing of the license form, according to the graphic solution of the licensor Association "BIOGEN".

Printing of the license by the printing house with which the legal entity issuing the license, the Association "BIOGEN" concluded the Agreement on business and technical cooperation in license printing - will provide all necessary conditions that will prevent forgery licenses.

The graphic solution and dry mark, conceptual solution are the property of the legal entity issuing the license, Association "BIOGEN".

Photocopying the license and using a photocopy of the license is prohibited. Due to the necessary regulations in other bodies and organizations, the photocopy is issued by the legal entity that issued the license and authenticates with its seal and the signature of the responsible person, each individual copy, and keeps records of the issued photocopies for each.

Article 26

Legal entity, license issuer Association "BIOGEN" maintains the Register of issued licenses of TM DZ/R method practitioners.

The costs of issuing a license, renewing a license and issuing photocopies are fixed and amount to 6,000.00 (six thousand dinars) for the entire period of validity of the license. The costs are paid to the license issuer's legal entity account at the bank where the legal entity has an account.

Article 27

After the establishment of the professional chamber of practitioners of traditional medicine methods, all competences for issuing licenses to practitioners of the TM DZ/R method as well as the Register of practitioners of the TM DZ/R method are transferred to the competence of the newly formed bodies of the formed chamber.

VI FINAL PROVISION

Article 28

This Rulebook shall enter into force on the eighth day from the day of its adoption by the bodies of the "BIOGEN" Association, and the regulatory provisions of this Rulebook shall be applied until the formation of the competent professional chamber of practitioners of traditional medicine methods by professional organization and registration of the chamber with the registrar of the Republic of Serbia, which registers legal entities.

After the transfer of jurisdiction to the Chamber of Traditional Medicine, the provisions of this rulebook will be adapted to the documents and regulations that this chamber prescribes and adopts.

Article 29

This rulebook shall enter into force on the following day from the day of its publication and highlighting on internet portals, bulletin boards and communication in writing to the subsidiaries formed by the legal entity, BIOGEN, until the day of the adoption of this rulebook .

Article 30

The regulations are fully in line with all valid legal acts governing the area: Health care of citizens of the Republic of Serbia, Environmental protection, Protection of citizens from non-ionizing radiation, Statute and codes of the Serbian Medical Association, Statute and Ethics Codex and the Code of Competence of Traditional Medicine Practitioners for the method of detection and protection against non-ionizing radiation of the professional association that trains practitioners of the TM DZ/R method, Association "BIOGEN".
